Understanding Salary TDS: Current Section 392

How employers estimate and deduct salary tax under Section 392 for Tax Year 2026-27, including employee evidence and excess-credit reconciliation.

How Salary TDS Works Under Section 392

Current Section 392 replaces legacy Section 192. The employer estimates tax on the employee's taxable salary and other permitted information for the full tax year, gives effect to the declared regime and supported deductions, and deducts at the average rate over salary payments. TDS is based on estimated tax payable, not merely on whether gross salary exceeds one basic-exemption number.

Employee Declarations and Evidence

Give the employer the declaration and evidence requested under the current 2026 Rules/payroll process. Relevant facts can include HRA location, rent and landlord details; Section 123/Schedule XV investments; Section 126 medical premiums by eligible category; Section 124 NPS contribution; and a complete Section 22 house-property computation. A declaration affects withholding but does not make an ineligible amount deductible in the return.

Salary TDS Certificate and Tax-Credit Data

Use the salary TDS certificate issued in the current prescribed form and reconcile employer details, salary, deductions and tax with AIS and the tax-credit statement on the official portal. A certificate is evidence, not a substitute for checking the return; multiple employers and other income can change final tax.

What if Excess TDS is Deducted?

Provide corrected information to the employer while payroll can still adjust deductions. If final TDS exceeds final liability, claim the credit in the applicable return after reconciling the employer certificate, AIS and tax-credit statement. Refund timing is not guaranteed. When changing jobs, disclose prior salary and TDS in the current prescribed manner so the new employer does not compute on only part-year income.

Advance Tax Obligations

Other income can create an advance-tax shortfall even when salary TDS is correct. The ordinary cumulative instalment schedule remains 15% by 15 June, 45% by 15 September, 75% by 15 December and 100% by 15 March, subject to taxpayer-category rules. Interest can apply to shortfall or deferment; use the current Act section and official calculator rather than legacy Section 234B/234C labels.
