NRI tax on money sent to India

Classify an inward remittance to India by ownership, purpose, relationship, residential status and place of first receipt. Sending money is not automatically the taxable event; the underlying source can be.

Classify money sent to India

Describe the underlying money—not just the bank-transfer narration. The transfer itself and the income or gift that produced it are separate tax questions.

For gifts, the annual aggregate can matter—not only this transfer.

generally not income

A transfer of your own previously received savings is generally not new income merely because it reaches India.

The transfer changes the location of your own money; it does not by itself create a second income event. Preserve evidence that the income or capital was first received outside India and belonged to you.

Evidence checklist

  • Keep the bank remittance advice and account statement.
  • Keep documents showing the source, owner and original receipt date of the money.
  • Check the receiving account type and current bank/FEMA requirements separately.

Important limits

  • Banking, FEMA, account eligibility and tax are separate questions.
  • Confirm residential status, income source, treaty rules and bank/FEMA requirements independently.

Direct answer

Is money sent to India taxable for an NRI?

A transfer of your own money already received abroad is generally not fresh income merely because it is remitted to India. But current income first received in India, a taxable non-relative gift, salary, business receipts or gains connected with an asset can require Indian tax analysis. The remittance label alone does not decide the answer.

  1. 1Identify the legal owner and the real source of the money.
  2. 2Establish where and when the underlying amount was first received.
  3. 3Check the recipient’s NR, RNOR or ROR status for the relevant tax year.
  4. 4Keep the bank trail and source documents, then review tax and FEMA/bank rules separately.
